Terms of Service

Services
Apex Systems AI provides automation consulting and implementation services, including workflow automation, voice reception systems, lead generation pipelines, CRM integrations, and custom API orchestration. Services are delivered under separate written agreements that define scope, timeline, and compensation.
No guarantee of specific outcomes
Results depend on many factors outside our control, including existing operations, staff adoption, market conditions, and third-party platform behavior. Case studies presented on this website are real but are not a guarantee that you will achieve the same outcomes. We do not make income guarantees.
Any guarantee language used in project proposals applies only to the specific engagement and conditions described in that proposal.
Client responsibilities
Clients are responsible for ensuring that the systems we build comply with all applicable laws and regulations in their industry, including HIPAA requirements for healthcare communications, TCPA, and any professional licensing requirements. We will advise on relevant compliance considerations, but our guidance does not constitute legal advice.
Intellectual property
Unless otherwise specified in a written agreement, clients own the custom workflows and system configurations we build for them upon full payment. We retain the right to describe the general nature of the engagement, without disclosing confidential details, for portfolio and marketing purposes.
Third-party platforms
The systems we build typically integrate with third-party platforms including GoHighLevel, Retell AI, Twilio, n8n, Make, Airtable, and Supabase. These platforms have their own terms and pricing. We are not responsible for changes to third-party pricing, terms, or availability.
Limitation of liability
To the maximum extent permitted by applicable law, Apex Systems AI and Frank Avendano shall not be liable for indirect, incidental, special, or consequential damages arising from use of our services. Total liability for any claim shall not exceed the total amount paid for the specific engagement.
Governing law
These terms are governed by the laws of the State of California. Disputes shall be resolved in the courts of San Diego County, California.
Changes to these terms
We may update these terms from time to time. If we make material changes, we will update the effective date at the top of this page. Continued use of our services after such changes constitutes acceptance.
